Warranty Claims and Terms
Product is warrantied for years mentioned ,for any manufacturing fault with following terms.
Any physical damage to the machine is not covered. It is strongly recommended that servo motor based
voltage stabiliser be used to avoid any damage by electricity malfunction.
During the warranty period if any fault occurs, it will be rectified free of cost. Any spare required will be provided free of cost by the manufacturer but buyer shall bear the transportation charges from china to Pakistan plus any custom duty involved.
During the warranty period, visit to client premises shall be charged, if visit is due to client’s negligence or there is no fault.
Operation and maintenance is client’s responsibility, if client request for any related matter it shall be charged accordingly.
Once the warranty period has lapsed, visit to client site for repair related activities shall be charges at the rate 12000 pkr per visit plus client shall bear the cost of spare and transportation of spare charges.
Claims and arbitration
∙ The two parties mutually agree to fulfils the terms and conditions specified in the contract, party who violates the specified terms and conditions must be responsible for and compensate the loss caused to the other directly by his violation.
∙ This contract will be governed by the provision of "Incoterms 2010" & "Law of Contract 1872". If any dispute arises under this contract which both the parties cannot resolve amicably then dispute shall be resolved by Arbitration Board of Local Courts or ARD in jurisdiction of both the residing parties & all the expenses occurred in this arbitration shall be borne by losing party.
FORCE MAJEUR
Force majeure circumstance must be notified by email / telephone by the one party to the other within seven days. After such notification, a certificate of force majeure issued by the competent Authority shall be sent to the other party. Beyond this time Force majeure circumstance shall not be taken into consideration.
GENERAL CONDITIONS
The contract shall be effective and binding on the all parties from the date of signing ∙ This contract may not be assigned by the buyer without written consent of the seller. ∙ The contract shall be drafted in “two” copies and signed by the both parties. One copy for the buyer and other for the seller.
